new driveway defect



i had a large circular drive added to my hse. 34 yrs. ago when new. since then we've added two additions, necessitating trash dumpsters, heavy construction vehicles, etc. we have never had gouging on the drive. had it totally redone in april and shortly after noticed gouges at the entrance. contractor said he doesn't guarantee that but put a patch on. since then we have many gouges there. they told my husband to enter his car one wheel at a time. this seems silly since visitors wouldn't know about this. it seems that the elevation at the beginning of drive needs to be leveled some. is this something that should be covered by warranty? thanks.
